We are an agency for the purposes of the Privacy Act 2020 (New Zealand) and comply with its Information Privacy Principles (IPPs), including IPP 3A (notification for indirect collection), which came into force on 1 May 2026.

This statement is our public-facing transparency document. It should be read together with our Cookie Policy and Terms of Use.

3. What Is Personal Information?

Under the Privacy Act 2020, personal information means information about an identifiable individual. This may include your name, email address, phone number, message content, IP address, device identifiers, and online usage data where it can be linked to you.

4. Information We Collect and How We Collect It

4.1 Information you provide directly (IPP 3)

When you contact us or register for an event, we may collect:

We collect this information directly from you via our contact form, email, phone, or in person at workshops. Before or at the time of collection, we tell you why we need the information and who may receive it (see sections below).

4.2 Information collected automatically

When you browse our website, we or our service providers may automatically collect technical information such as IP address, browser type, operating system, device type, pages viewed, time spent on pages, and referral URLs. Where analytics or marketing tools are enabled, this occurs only with your consent via our cookie banner. See our Cookie Policy.

4.3 Information collected indirectly (IPP 3A)

If we receive personal information about you from a third party — for example, a referral from another participant, a booking platform, or a social media enquiry forwarded to us — we will take reasonable steps to make sure you are aware that we have collected your information, our identity and contact details, the purpose of collection, the intended recipients, and your rights to access and correct that information, unless an exception under IPP 3 or IPP 3A applies.

5. Purposes of Collection and Use (IPP 1 and IPP 10)

We collect personal information only for lawful purposes connected with our activities, and we use it only for those purposes or directly related purposes. Our purposes include:

We will not use your personal information for a new purpose that is unrelated to the original purpose unless we believe you would reasonably expect such use, or we have your consent, or the law authorises it.

6. What Happens If You Do Not Provide Information (IPP 3)

Providing personal information through our contact form is voluntary. However, if you do not provide your name, email address, or message, we may be unable to respond to your enquiry. If you do not consent to our collection and use of your information as described in this statement, please do not submit the contact form.

7. Disclosure of Personal Information (IPP 11)

We do not sell or rent your personal information. We may disclose personal information to:

We require third parties that handle personal information on our behalf to protect it and use it only for the purposes we specify.

8. Disclosure to Overseas Recipients (IPP 12)

Some of our service providers may store or process personal information outside New Zealand — for example, cloud hosting, email, or analytics providers based in Australia, the United States, the European Union, or other countries. Before disclosing personal information overseas, we take reasonable steps to ensure that the recipient protects the information to a standard comparable to the Privacy Act 2020, unless an IPP 12 exception applies (such as your authorisation, or the information being publicly available with your consent to republication).

By using our website and consenting to analytics or marketing cookies, you authorise overseas disclosure to the extent described in our Cookie Policy.

9. Storage, Security, and Retention (IPP 5 and IPP 9)

We take reasonable safeguards to protect personal information against loss, unauthorised access, use, modification, or disclosure. Measures include HTTPS encryption, access controls, secure hosting environments, and limiting access to staff and contractors who need the information to perform their duties.

We retain personal information only for as long as necessary for the purposes for which it was collected, unless a longer retention period is required or permitted by law:

When personal information is no longer needed, we take reasonable steps to destroy it or ensure it is de-identified.

10. Accuracy (IPP 8)

We take reasonable steps to ensure personal information is accurate, up to date, complete, relevant, and not misleading before we use it or disclose it. Please let us know if your details change so we can keep our records current.

11. Your Rights: Access and Correction (IPP 6 and IPP 7)

Under the Privacy Act 2020, you have the right to:

To make a request, contact us at welcome@sparkfresh.world. We will respond within 20 working days as required by the Privacy Act 2020, or inform you if an extension applies. We may need to verify your identity before releasing information.

If we decline an access or correction request, we will explain our reasons and inform you of your right to complain to the Office of the Privacy Commissioner.

If we correct information, we may also notify third parties to whom we have disclosed it, where reasonably practicable.

12. Unique Identifiers (IPP 13)

We do not assign unique identifiers (such as customer reference numbers) unless reasonably necessary for our functions. If we do assign a unique identifier, we take reasonable steps to prevent misuse and do not share it unnecessarily with other organisations.

13. Marketing and Electronic Messages

We will only send commercial electronic messages (such as promotional emails about workshops or events) where permitted under the Unsolicited Electronic Messages Act 2007. This generally means we will send marketing communications only if you have given express consent, there is an existing business relationship and an unsubscribe facility is provided, or another lawful exception applies.

Every marketing email will include a clear way to unsubscribe or opt out. You may also contact us at any time to withdraw marketing consent.

14. Cookies and Online Tracking

Our use of cookies, local storage, and similar technologies is described in our Cookie Policy. Where these technologies collect personal information, the Privacy Act 2020 applies.

15. Notifiable Privacy Breaches

Under the Privacy Act 2020, if we experience a privacy breach that has caused or is likely to cause serious harm to affected individuals, we are required to notify the Office of the Privacy Commissioner and affected individuals as soon as practicable. We maintain internal procedures to identify, assess, contain, and respond to privacy breaches.

If you believe your personal information has been compromised in connection with our services, please contact us immediately at welcome@sparkfresh.world.

16. Children's Information

Our website and services are directed at adults. We do not knowingly collect personal information from children under 16 without parental or guardian consent. If you believe we have collected information from a child, please contact us and we will take steps to delete it.

Our website is operated from New Zealand. If you access our site from outside New Zealand, your information may be transferred to and processed in New Zealand.
