1. Agreement to Terms

By accessing and using sparkfresh.world (the "Website"), operated by Sparkfresh.ddd ("we", "us", "our") from New Zealand, you agree to these Terms of Use. If you do not agree, please do not use the Website.

These Terms are governed by New Zealand law. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or the Privacy Act 2020 where those laws apply and cannot be excluded.

3. Nature of Content, Services, and Disclaimer

All content on this Website — including articles, guides, workshop descriptions, and lifestyle education information — is provided for general lifestyle and educational purposes only. It does not constitute professional, medical, dietetic, psychological, or therapeutic advice, and does not create a practitioner–client relationship.

Our paid and free offerings are educational programmes about everyday eating skills (such as noticing hunger, making food swaps, and building habits). They are not medical treatments, weight-loss programmes, clinical dietetic services, or substitutes for care from a registered dietitian or doctor.

We do not promise specific physical, emotional, or weight-related outcomes. Any examples on this Website describe general learning experiences and may not apply to your situation. You should seek advice from a qualified healthcare provider or registered dietitian before making significant changes to your diet or lifestyle, especially if you have specific health conditions, allergies, or dietary requirements.

We make no representations or warranties about the completeness, accuracy, currency, or suitability of the information for any particular purpose. Reliance on Website content is at your own risk.

Under the Fair Trading Act 1986, we do not make false, misleading, or deceptive representations about our services or the outcomes you may experience. Individual experiences vary and depend on personal circumstances.

4. Services and Consumer Rights

If you purchase workshops, education sessions, or other paid services from us, those services are supplied subject to the Consumer Guarantees Act 1993 where you acquire them as a "consumer" for personal, domestic, or household use. Under that Act, services must be carried out with reasonable care and skill, be fit for a particular purpose you have made known, and be completed within a reasonable time.

If there is a problem with a service we provide, contact us so we can seek to resolve it. Your remedies under the Consumer Guarantees Act may include requiring the service to be brought up to standard or, in some cases, a refund. Where the Act applies, our liability is not limited below the minimum standards it requires.

Bookings and cancellations: Workshop and session fees are confirmed at booking. To cancel or reschedule a paid session, contact us as soon as possible. Cancellations at least 48 hours before a scheduled session may be rescheduled without extra charge, subject to availability. Late cancellations or no-shows may forfeit the session fee except where the Consumer Guarantees Act or other applicable law provides a remedy.

Refunds: We do not sell supplements, meal replacements, or weight-loss products. Refund entitlements for paid services are described on our contact page and under the Consumer Guarantees Act 1993.

Nothing in these Terms excludes, restricts, or modifies rights or remedies you have under the Consumer Guarantees Act or other New Zealand consumer protection laws that cannot lawfully be excluded.

5. Acceptable Use

You agree to use the Website lawfully and in accordance with these Terms. You must not:

6. Intellectual Property

All text, graphics, logos, images, layout, and software on this Website are owned by or licensed to Sparkfresh.ddd and protected by the Copyright Act 1994 and other intellectual property laws.

You may view and print pages for personal, non-commercial use. Any other reproduction, adaptation, distribution, or commercial use requires our prior written consent.

7. User Submissions and Personal Information

When you submit information through our contact form or event registration, you confirm that the information is accurate to the best of your knowledge and that you have the right to provide it.

We handle personal information in accordance with our Privacy Statement and the Privacy Act 2020. By submitting the contact form, you confirm that you have read our Privacy Statement and consent to our collection, use, and disclosure of your personal information for the purposes described there.

8. Third-Party Links and Embeds

The Website may contain links to third-party websites or embedded content (such as Google Maps). We do not control and are not responsible for the content, availability, privacy practices, or security of third-party sites. Accessing them is at your own risk. Third-party services are subject to their own terms and privacy policies.

9. Limitation of Liability

To the fullest extent permitted by New Zealand law, we are not liable for any direct, indirect, incidental, consequential, or special loss or damage arising from your use of the Website or reliance on its content, including loss related to dietary choices, lifestyle changes, or business interruption.

Where the Website is not supplied in trade, or where liability cannot be excluded, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or for fraud or wilful misconduct.

Free informational content on the Website is provided on an "as is" basis. We do not guarantee uninterrupted or error-free access.

10. Indemnity

You agree to indemnify and hold harmless Sparkfresh.ddd against claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms or misuse of the Website, except to the extent caused by our negligence or breach of law.

11. Privacy and Cookies

Your use of the Website is also governed by our Privacy Statement and Cookie Policy, which describe how we collect, use, store, and disclose personal information in compliance with the Privacy Act 2020 and its Information Privacy Principles.

12. Electronic Communications

By providing your email address, you consent to us communicating with you electronically about your enquiries and, where you have opted in, about our services. Marketing communications are sent in accordance with the Unsolicited Electronic Messages Act 2007 and include an unsubscribe option.

13. Governing Law and Disputes

These Terms are governed by the laws of New Zealand. You agree to submit to the non-exclusive jurisdiction of the New Zealand courts.

Before commencing legal proceedings, we encourage you to contact us to try to resolve any dispute informally. If you are a consumer, you may also contact Consumer Protection (Ministry of Business, Innovation and Employment) or use the Disputes Tribunal for eligible claims.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable under New Zealand law, the remaining provisions continue in full force and effect.

15. Changes to Terms

We may revise these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Material changes may also be communicated where appropriate. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms, except where prohibited by law.

16. Contact
